Overview:

"This Course is approved for 1 general credit from the Nevada Board Of Continuing Legal Education."

Overview: There is a secret to HIPAA - the HIPAA Rules are easy to follow step-by-step when you know the steps. This webinar explains the simple steps allowing unencrypted Email and Text Messaging with patients. Email and Text Messages are Electronic Transmissions subject to the HIPAA Security and Privacy Rules. Patients have an absolute right to receive unencrypted Emails and Text Messages containing PHI from or on behalf of their Healthcare Providers. HHS guidance issued in 2013, 2014 and 2016 clearly and unequivocally explains the simple steps Covered Entities must follow to send unencrypted Email and Text Messages to patients. These include Emails and Text Messages sent by a Business Associate on behalf of a Covered Entity. This webinar explains the steps that provide a "Safe Harbor" for Covered Entities if an unencrypted Email or Text Message to a patient is intercepted or read by an unauthorized third party. It uses moving graphic displays to explain the important HIPAA definition of PHI clearly. HIPAA law is not intuitive.

When you see the display and listen to the explanation you will understand why Emails and Text Messages between Health Care Providers and patients contain - by definition - PHI. The webinar will also explain very clearly why TCPA provision that appears to provide protection ('exemption") for informational healthcare Text Messages like appointment reminders is dangerous and essentially worthless.

Why should you Attend: You should attend this webinar:
  • To learn the HIPAA Rules and HIPAA "Safe Harbor" - 3 simple steps - allowing unencrypted Email and Text Messaging with patients
  • To examine the HIPAA definition of PHI. It's not what many people think
  • To see why common advice not to include PHI in Emails or Text Messages with patients is dangerous because - as HIPAA defines PHI - it is advice that is impossible to follow
  • To avoid HIPAA Text Message violations encouraged by misunderstanding and misinterpretation of the TCPA. These are particularly dangerous because the TCPA allows private, class action lawsuits with very heavy financial consequences
  • To understand The Joint Commission ban - it covers all Text Messages containing PHI - not just the secure texting of Orders
Don't be the Provider or Business Associate that finds itself in serious trouble simply because you didn't follow the simple HIPAA Rules for unencrypted Email and Text messaging with patients

Areas Covered in the Session:
  • 3 Simple Step Compliance with the HIPAA Privacy and Security Rules concerning unencrypted Email and Text Messaging with Patients
  • PHI - the HIPAA definition explained clearly and why and how it applies to Email and Text messaging
  • TCPA's & HIPAA - why the TCPA healthcare Text Message exemption for informational healthcare messages like appointment reminders is useless - but how HIPAA's Safe Harbor - and only HIPAA's Safe Harbor - allows the sending of unencrypted healthcare Text Messages
